Terms of Service

These Terms govern your use of HopeDesk, operated by Five & Two Ministries (“HopeDesk,” “we,” “us”). By creating an account or using the service, you agree to these Terms on behalf of your organization.

The service

HopeDesk is a multi-tenant appointment-scheduling platform for nonprofit pregnancy resource centers. It includes an embeddable booking widget, a scheduling dashboard, contacts, and automated email and text notifications. Features vary by plan.

Accounts

You must provide accurate information and keep your login credentials secure. You are responsible for activity under your accounts, including the staff you invite. Notify us promptly of any unauthorized use.

Acceptable use

You agree that you will not, and will not allow your users to:

  • Store protected health information (PHI) or other regulated medical/clinical records in HopeDesk. HopeDesk is a scheduler and non-clinical contact list, not a medical record system.
  • Use the service unlawfully, or to harass, harm, or deceive the people you serve.
  • Upload malware, attempt to breach security, or disrupt the service or other tenants.
  • Resell or provide the service to third parties outside your organization without our consent.

Your data

As between you and HopeDesk, your organization owns the data it puts into HopeDesk (“Customer Data”). You grant us the limited rights needed to host and process Customer Data to provide and improve the service. You are responsible for the accuracy of Customer Data and for having the right to provide it, including any personal information about the people you serve.

Messaging & communications compliance

When you send emails and text messages through HopeDesk, you are responsible for complying with applicable laws, including the TCPA, CAN-SPAM, and carrier requirements. You must obtain and maintain the necessary consent before contacting recipients, send only appointment-related and other permitted messages, and honor opt-out requests. HopeDesk captures SMS consent on the booking form and processes STOP requests to help you, but you remain responsible for your messaging program and content. Carrier and message fees may apply.

Plans, trials & billing

Paid plans are billed through Stripe on a monthly or annual basis. New subscriptions may include a 14-day free trial; a payment method is required up front, and unless you cancel before the trial ends, your subscription automatically begins and your card is charged.

You can change or cancel your plan at any time from the billing page; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law. If a payment fails, access to paid features may be paused until billing is updated. We may change pricing with reasonable advance notice.

Third-party services

HopeDesk relies on third-party providers (including Neon, Vercel, Resend, Telnyx, and Stripe). Your use of the service is also subject to those providers’ terms where applicable. See our Privacy Policy for how data is shared with them.

Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law, HopeDesk and Five & Two Ministries will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim.

Indemnification

You will defend and indemnify HopeDesk and Five & Two Ministries against claims arising from your Customer Data, your messaging, or your misuse of the service or violation of these Terms.

Termination

You may stop using HopeDesk and cancel at any time. We may suspend or terminate access for violations of these Terms or to protect the service. On termination, your right to use the service ends and we will handle your data as described in the Privacy Policy.

Governing law

These Terms are governed by the laws of the United States and the state in which Five & Two Ministries is organized, without regard to conflict-of-laws rules.
